Remember: As an unaccompanied child, you may be able to apply for special protection, like asylum. It is important for you to talk to an immigration attorney, like Gilberto did and discuss your case. An attorney can help explain the asylum process and see if you qualify for asylum or another form of relief.
 
In May 2014, Gilberto was just 13 years old when he fled Guatemala and headed to the US.  He feared MS-13 gang members would eventually kill him because he refused to sell drugs for them. He was hoping to be reunited with his father who lived in California. He arrived at the US border after a very difficult journey. He saw many terrible things and was kidnapped twice before finally being taken to an Office of Refugee Resettlement (ORR) shelter.  In July 2014, Gilberto was finally released to live with his father in Southern California.
 
Because of the threats, harm, and persecution Gilberto suffered, he was able to ask for protection, known as asylum. His attorney, Linda Dakin-Grimm was able to help him file for asylum and has seen him grow from a shy young boy into a young man determined to help others.
 
Linda Dakin-Grimm helps unaccompanied children like Gilberto because “our laws are in place to protect every child and to protect their dignity, and to do what the world has long recognized is right for suffering human beings.”
 
Gilberto was granted asylum by an immigration judge and now has legal status to remain in the US. He was able to learn English and finished high school in 2019. Now he hopes to become a firefighter and help others. In April 2021, he became eligible to file to become a US citizen.

How an Attorney Helped Gilberto Win His Case

Remember: If your parents or other caregivers travelled with you to the border and were expelled back to Mexico, they may have been returned because of Title 42. If you later crossed the border alone as an unaccompanied child, it is important for you to talk to an attorney and share these details with them, so they can assess your case.

11/16/2022: A federal judge in the U.S. gave the Biden administration 5 weeks to end Title 42 — for now, it is set to end on December 21, 2022. However, this decision can change.
3/14/2022: The Biden administration recently decided that unaccompanied children are exempt from Title 42.

<h3 id="h_01HV744TB7S5TVHARS1F09GRXP">What is Title 42? </h3>
<ul>
<li>Title 42 is a Trump-era policy that began in March 2020.</li>
<li>It is part of US health law which allows any migrant caught entering the US without inspection (this means entering without permission through the desert, across a river, or any other area that is not a port of entry) to be expelled.</li>
<li>Under Title 42, most migrants are immediately turned away and are not given the opportunity to ask for asylum. President Biden has kept this policy in place and continues to return immigrant families who are often seeking asylum to Mexico or to their home countries.</li>
<li>Public health officials have pushed back on this policy and have argued that there is <a href="https://www.publichealth.columbia.edu/node/76271">no public health benefit</a> to Title 42.</li>
</ul>
 
<h3 id="h_01HV744TB7947C49BTF9RRMG5F">How does this affect unaccompanied children?</h3>
Adult caregivers, often single mothers, fathers, or other relatives who made the difficult journey north with children now find themselves immediately expelled to Mexico and have to make a heartbreaking choice. They can either try to stay in Mexico and wait months for Title 42 to be lifted, so they can try to ask for asylum, or they can send their children across the border as unaccompanied children.  Parents sometimes feel this is their only viable option, as they assess the daily dangers they face at the border. As a result of Title 42, family separation continues in a different form and is mostly outside of public view.  In March 2021, there were an estimated 19,000 unaccompanied children traveling alone across the border—this is the highest number ever recorded. According to data, many of these children had previously tried to enter with a parent but had been expelled.
 
The children who cross are often picked up by Customs and Border Protection (CBP), processed, and then moved into Office of Refugee Resettlement (ORR) shelters. Many are able to eventually reunite with parents or other relatives in the US. Upon release to their sponsors, unaccompanied children are provided with documents related to their case, and can try to seek asylum, special immigrant juvenile status (SIJS, a special protection for minors who have been abandoned, abused, or neglected), or other form of relief.

There are only two groups of people that can provide legal advice and help you with your immigration case:

<li>Lawyers</li>
<li>
Accredited representatives, who are recognized by the Department of Justice (DOJ) and the Board of Immigration Appeals (BIA).</li>
</ol>
IMPORTANT: A notary is NOT a lawyer in the United States. Notaries cannot legally help you with your immigration case. In the US, a notary is someone who prevents fraud by reviewing documents and making sure they are real. If someone tells you they are a notary (“notario publico”) that can offer you legal help or advice, you should not trust or work with them.

Working with a lawyer can be very beneficial because they can:

Listen to your story: A lawyer listens to your story to better understand your situation, help determine which legal pathway is best for you, and help you tell your story to the people who make decisions about your case in immigration court.</li>
<li>
Help you fill out the right paperwork: There are a lot of forms and documents that you need to fill out when you're trying to stay in the U.S. legally. A lawyer can help you make sure that you're filling out the right forms and that you're doing everything correctly.</li>
<li>
Represent you in court: A lawyer will be your advocate and help you make your case at court hearings. </li>
<li>
Advocate for you and your rights: A lawyer will make sure that your voice is heard and that your rights are protected.</li>

To find a good lawyer, it is important to work with someone who has experience in immigration law (and/or is a <a href="https://ailalawyer.com/" target="_blank" rel="noreferrer noopener">member of AILA</a>). You can check if a lawyer is licensed to practice in your state by following these steps:

Here are some more tips to help you choose a good attorney:
✔️ Review and ask any questions before signing a contract (the contract should be provided in your preferred language and explained to you – you have the right to ask for clear explanations)
✔️ Don’t sign anything you don’t understand
✔️ Understand what forms of relief you are applying for and the fees that will be charged (this should be clearly explained in the contract and include a payment plan, if needed)
✔️ Ask to see your attorney’s licensing documents to make sure they are legitimate
✔️ Ask for references from other clients they have worked with
✔️ Ask for copies of forms and documents submitted in your case

When you are looking for a lawyer or an accredited representative to help you, it is important to know your rights. It does not matter if you are paying the lawyer or if they are helping you for free (free services are also known as "pro bono"), they have the same responsibilities. Remember that you have the right to:

Fire your attorney or accredited representative. If you are not satisfied with the lawyer’s work, you do not have to stay with that lawyer.  </li>
<li>
Seek a second opinion on your case. You do not have to commit to the first lawyer you meet with – we recommend that you talk to multiple lawyers before deciding which to go with! </li>
<li>

Remember: It’s important that you find and meet with a lawyer to discuss your specific immigration case and all your options.
 
Sometimes calling a lawyer (also called an attorney) can feel scary, but it helps to remember that they want to help you! The first phone call to a lawyer is very simple. All you have to do when you call their office is tell them:

That you would like an initial consultation (which simply means the first meeting with the lawyer to discuss your case and options)

Make sure you keep track of which lawyers you have tried to contact and those you are currently in touch with – you can use <a href="https://docs.google.com/document/d/1heCTxu4A5tDJuiD6ePlf158TXWutvNAB/edit" target="_blank" rel="noopener noreferrer">this document</a> to take notes. This will make it easier for you to know who you need to reach out to again. It will also help you show that you have been trying to find a lawyer.
Important: While some initial consultations are free, some lawyers charge a fee for their initial consultations. It’s important to ask the lawyer whether or not they charge a fee BEFORE you meet with them. If they do charge a fee that you cannot pay, some nonprofits may offer a discount or a fee waiver (which means you would not have to pay).
 
<h3 id="h_01HV2TT3Y25SWXTF3FKK6FHWXX">If no one answers and you need to leave a message...</h3>
When you first call a lawyer’s office, it’s possible that no one will answer. You may hear a voice message on an answering machine speaking in English. If English is not your preferred language, stay on the line and wait until you hear options in Spanish. To leave a message, wait for the beep at the very end. Below is an example of a message you can leave on the machine. If you are only able to talk on WhatsApp or using a regular cell phone, please let them know that.

If someone does answer the phone when you first call, they will probably answer in English. Do not hang up! If English is not your preferred language, you can ask if there is someone who can speak to you in Spanish or whatever your preferred language is. For example, you can simply say “¿Hablan español?” or “¿Alguien habla español?” and they will know that you need a Spanish speaker. If they can, the person who answers might transfer you to someone else who also speaks your language. They may need some time to find an interpreter. If they transfer you to an interpreter, let the interpreter know all your information (like the example message in the box above).
Sometimes it’s a good idea to try calling back later so that you can leave a voice message with all of your information.

Remember that it may take several weeks for a lawyer or organization to get back to you, because many children may be calling. Don’t get discouraged and keep trying to reach out. If you don’t hear back from a lawyer you have contacted, you can check their website to see if they offer the option to book a consultation online.
You can also send the lawyer an email with all of the important information they need (your name, phone number, that you are an unaccompanied child who needs legal representation, and that you’d like an initial consultation). Remember: Minors (under 18) do not have ICE check-ins. Once you turn 18 (age-out), it is possible you will need to check-in with an ICE officer in the state where you live. We have resources available to help you with this process.

If you turn 18 years old and receive a notice to check-in with Immigration and Customs Enforcement (ICE), it is important for you to go to this appointment. This is different from your court hearing with an immigration judge. You need to go to both your ICE check-ins and court hearings.

Where do I go?: Your notice will tell you where you need to go for your check-in. If you don't know or are unsure of where the ICE office is located, you can check the <a href="https://www.ice.gov/check-in#Locations" target="_blank" rel="noopener noreferrer">ICE Office location list</a> (this includes addresses, hours, phone numbers, and emails). </li>
<li>
How often do I have to check-in?: You may need to check-in with an ICE officer every month, every 3 months, every 6 months, or once a year--it depends on your specific case. Your ICE officer will tell you when you need to return and it should also be listed on your <a href="https://help.asylumadvocacy.org/ice-check-in-log/" target="_blank" rel="noopener noreferrer">Personal Report Record</a> (this document will have your address, A Number, picture, and fingerprint).</li>
<li>
Do I go in person or use my phone?: Your first ICE check-in will likely be in person. In the unlikely event of temporary office closure, there may be an option to check-in with your phone using an approved app that sends your picture and additional information to your ICE officer.</li>
<li>
Can my attorney go with me to my check-ins? You should always keep your attorney informed about your ICE check-ins and many attorneys will be able to go with you to your check-ins. Your attorney can also talk to your ICE officer on your behalf and help you if you are having issues with your in-person check-ins or when using the app.</li>
<li>
If I don't have an attorney, can I go with someone else? Yes, there are accompaniment programs, where community volunteers are able to drive you to your ICE check-in and they can stay with you as you wait to see your ICE officer. They are not attorneys, and cannot provide legal advice, but they want immigrants, and especially children, to feel welcome. This can make it easier for you to go to your check-in. Contact us and we can help you find an accompaniment program in your area.</li>
<li>
What should I do if I move? 
<ul>
<li>You need to tell your ICE officer, if you are going to move or change your phone number.</li>
<li>You can also contact the ICE Victims Engagement and Services Line at 1-833-383-1465 or go to <a class="survey-processed" href="http://www.ice.gov/vesl">ice.gov/vesl </a>and someone will help you.</li>
<li>To change your address with the immigration court (EOIR), you need to fill out form EOIR-33 as well. You can fill out and submit <a href="https://respondentaccess.eoir.justice.gov/en/forms/eoir33ic/" target="_blank" rel="noopener noreferrer">this form online</a> or on your phone (see QR code below).</li>
